Terms of Service (EULA)

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and TSAVORITE GROUP L.L.C-FZ ("Company", "we", "us", or "our"), regarding your access to and use of the Gemirror mobile application and related web services.

By downloading, installing, or using Gemirror, you agree to be bound by these Terms and the Apple Standard End User License Agreement (EULA). If you do not agree, do not install or use the application.

2. Nature of Gemstone Valuation (Important Appraisal Disclaimer)

INFORMATIONAL & ESTIMATIVE USE ONLY: Gemirror provides market valuation estimates synthesized via optical computer vision algorithms, user-supplied factual parameters (weight, origin, treatment), laboratory certificate extractions, and compiled international auction trade data.

• Not a Certified Legal Appraisal: Valuation ranges, dealer pricing, and scores provided by Gemirror do NOT constitute a certified gemological laboratory report, formal legal appraisal, bank insurance guarantee, or an offer to purchase or sell any gemstone.
• Physical Inspection Limitations: Smartphone cameras and 2D photographs cannot detect internal microscopic inclusion structures, high-temperature heat treatment residues, lattice beryllium diffusion, or synthetic growth characteristics with laboratory certainty. High-value transactions must always be confirmed by physical examination at an accredited gemological laboratory (e.g., GIA, Gübelin, SSEF, GRS, Lotus).
• No Financial or Investment Advice: Valuation figures reflect historical and prevailing market ranges and should not be relied upon as investment advice. Gemstone values fluctuate based on market demand, supply, and liquidity.

3. In-App Purchases and Consumable Credits

The Gemirror application offers digital in-app purchase options to unlock valuation dossiers:

• Consumable Valuation Credits: Users may purchase single or bundled evaluation credits (e.g., Retail Evaluation, Trade Pass Evaluation). Each completed valuation consumes one credit.
• Billing and Processing: All in-app purchases are billed and processed directly by Apple through your Apple ID account in accordance with Apple Media Services Terms and Conditions.
• Refunds: Since all payments are handled by Apple, refund requests must be submitted directly to Apple Customer Support via reportaproblem.apple.com.
• Restoring Purchases: Non-consumable entitlements or active passes may be restored at any time within the application by tapping "Restore Purchases" in the settings screen.

4. User Content & Intellectual Property

You retain ownership of photographs and certificate scans you upload to Gemirror. By uploading imagery, you grant the Company a worldwide, non-exclusive, royalty-free license to host, transmit, and analyze such content solely to provide valuation outputs to you.

All rights, titles, and interests in the Gemirror software, user interface design, logos, and valuation algorithms are the exclusive property of TSAVORITE GROUP L.L.C-FZ.

5. Prohibited Activities

You agree not to:

• Upload fraudulent, counterfeit, deceptive, or maliciously manipulated gemstone photographs or forged certificates.
• Decompile, reverse-engineer, disassemble, or attempt to derive the source code of the Gemirror application.
• Use automated scripts, bots, or scrapers to extract valuation data from our APIs without explicit written consent.

6. Limitation of Liability

To the maximum extent permitted by applicable law, TSAVORITE GROUP L.L.C-FZ, its officers, employees, and licensors shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, commercial transactions, or asset value resulting from your reliance on gemstone valuations produced by the application.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Dubai.
